Terms of Use

These Terms of Use (“Terms”) govern your use of the website https://en.training.qatestlab.com/ and other services (“Services”) provided via the online resource QaTestLab Training Center. Services are offered by QATESTLAB LIMITED, having its registered office at 34 Falirou Street, 1st floor, office 115, Strovolos, 2066, Nicosia, Cyprus, Registration number HE 412671, and its affiliate companies and subsidiaries (hereinafter – “QATESTLAB”, “we”).  By clicking “Apply” when creating a user account or by using our Services, you agree to be bound by these Terms, including the policies referenced in these Terms.

1. Users

You may use our Services only if you are an individual and have a full legal capacity to do that under the laws of your residency. If you are a minor under the laws of your residency, you may use the Website and receive Services only with the approval of your parent or guardian.  

When using our Services you shall comply with these Terms, all applicable laws, and our policies Any violation of our Terms, applicable laws, or Policies may result in your access to all or part of the Services being suspended, disabled, or terminated.

You need an account for most activities. When setting up and maintaining your account, you must provide complete information, including a valid email address, phone number, first name, last name, gender, education, social media, and source where you got the information about the course from. You have complete responsibility for your account and everything that happens on your account, including for any harm or damage (to us or anyone else) caused by someone using your account without your permission. You may not share your account login credentials with anyone else. 

Unregistered users may access only certain pages and functionalities of the website, mainly for informational purposes.

If you apply for an online course studying option, you have to go through the evaluation process. The evaluation consists of a test. We at our sole discretion reserve the right to refuse both launching your evaluation or to provide Services any time after your successful evaluation but before entering into an online course. You might need to fill in our form with your information to submit an application. 

 2. Content Enrollment and Access

Subject to these Terms, We grant you a limited, personal, non-exclusive, non-transferable, and revocable license right to use our Services. The rights granted herein are only for your personal, non-commercial use. Using our Services does not give you ownership of or any intellectual property rights in our Services or the content you access.

You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any content.

Any use of our Services for commercial purposes is strictly prohibited.

You can only use our Services for lawful purposes. Your use of the Services must comply with applicable local or national laws or regulations of your country. You are solely responsible for the knowledge of and compliance with such laws and regulations that are applicable to you.

The Services may not be authorized for use in certain other jurisdictions that are subject to embargoes or any economic sanctions, as applicable.  We may restrict access to courses for learners from a country or territory which is itself the subject or target of any sanctions.

You hereby represent and warrant that you are not: (i) currently the subject or target of any sanctions, trade embargoes imposed, administered or enforced from time to time by relevant Governmental Bodies, including, but not limited to those administered by the U.S. government through OFAC or the U.S. Department of State, the United Nations Security Council, the European Union, or Her Majesty’s Treasury of the United Kingdom or included on any government’s sanctions list(s); or (ii) prohibited from accessing or paying for the Service due to sanctions laws or regulations applicable to your location or country of residence; or (iii) a resident of sanctioned jurisdictions according to any trade embargoes, sanctions regime.

We reserve the right to revoke any license to access and use any content and ban your account at any time, with or without notice, in the event that we decide or are obligated to disable access to the content for any or no reason, including for any violation of these Terms, for unexpected technical issues or problems, if we suspect that you engage in fraudulent or illegal activities, or for any other reason in our sole discretion. Upon any such termination, we may delete your account and content. You agree that we will have no liability to you or any third party for the termination of your account, removal of your content, or blocking your access to our services.

 3. Online courses

We provide Services via online courses (the “course”). Course is a program, which consists of a number of lessons on different topics placed in a specific sequence. Lessons are held twice a week. 

Users are notified on the course starting date and the lessons schedule by the confirmation email once the application they have filled in is accepted. In case the group is formed, the application can be shifted and accepted to the next available one. The courses take from one to three months depending on the type. 

Users are required to complete their homework before deadlines if they are set. 

Users are not provided with coaches and mentors for the whole course. Users should do the homework by themselves following the instructions. But We will help you to master the course by reviewing your work, giving feedback, and answering organizational questions in the online chat, email, or Telegram group.

During the course, we will be gradually granting you access to training materials necessary for completing specific homework.

Online studying option requires group task completion as well as individual work. You agree to submit your work on time and with the best efforts. In the event of missing deadlines or regularly submitting bad-quality work, you will face the consequences prescribed by these Terms.

Our Specialists are obliged to give you feedback with comments about your work if it was done before the deadline. If the time for correction is up the feedback can be in the form of confirmation that the task was checked and evaluated.

If you decide to do another course, you need to apply for it and pass an admission test specific to that course.

During a course, you agree to be available for the course, and you represent and warrant that you will not be under any other obligations that may interrupt your receiving Services. The User can’t be deleted from the group after it started.

During receiving Services, we may recommend you using third-party websites, online services, software or other products or services. These recommendations are provided to you for the sole purpose of successful completion of course training materials. 

QATESTLAB is not responsible for the content of any referred third-party products or services. Any third-party products or services are independent of QATESTLAB. We have no control over them. Use of any third-party product or service is subject to its terms of service and privacy policy or other legal documentation. 

In no event shall any reference to any third-party product or service be construed as an approval or endorsement by QATESTLAB of that third party or of any product or service provided by a third party. A recommendation to use any third party product or service does not imply that we endorse or accept any responsibility for the content or use of such product or service as well as will not be a party to or in any way monitor any transaction involving any third party providers of products or services. As with the purchase of a product or service, you are responsible for exercising appropriate judgment and caution.

Access to the learning system is guaranteed for 3 months from the date of registration. However, we may revoke or continue this access if there are legal grounds.

The participant is engaged to do the practical tasks individually and provides only the result of her|his own work for evaluation.

Users are required to not distribute questions and answers to questions used in the learning process publicly and on the Internet and use only one work account and not share it with other people.

Users are obliged to respect the copyright rights of the course creators and not distribute course materials provided to them. And do not publish or use in homework resources, symbols, media files, or text files that violate the respective law.

4. User Content

The Services enable you to share your content, such as homework, projects, other assignments you submit, and posts you make in the chat with our instructors, and/or other users. You retain all intellectual property rights in and are responsible for the user content you create and share.

To the extent that you provide user content, you grant QATESTLAB a fully-transferable, royalty-free, perpetual, sublicensable, non-exclusive, worldwide license to copy, distribute, modify, create derivative works based on, publicly perform, publicly display, to make modifications or edits to it as we see fit, and otherwise use the user content. 

You also waive any rights of privacy, publicity, or other rights of a similar nature applicable to all these uses, to the extent permissible under applicable law. You represent and warrant that you have all the rights, power, and authority necessary to authorize us to use any content that you submit. You also agree to all such uses of your content with no compensation paid to you.

We reserve the right to remove or modify User Content for any reason, including User Content that we believe violates these Terms or other policies. 

We welcome your suggestions, ideas, comments, and other feedback regarding the Services (“Feedback”). By submitting any Feedback, you grant us the right to use the Feedback without any restriction or any compensation to you. 

5. Payments, Refunds and Cancellation policy

We offer paid courses for a fee. Fees are quoted in USD. You are responsible for paying all fees charged by or for QATESTLAB and applicable taxes in a timely manner with a payment mechanism associated with the applicable paid courses. You agree to pay the fees for courses that you purchase, and you authorize us to charge your debit or credit card or process other means of payment for those fees.

If you cancel the course booking within 14 calendar days of receiving your order confirmation and before the start of the course without giving any reason, you are entitled to a full refund of the price paid

You have the right to cancel the course booking at any time at the following terms:

  • if you cancel the course booking within 14 days or more of making payment and before the start date of the course without giving any reason you will be eligible for a full refund. If you cancel less than 14 days before the start date of the course you will not be eligible for any refund;
  • if you start to use our services during the cancellation period (i.e. if the course commences during the 14-day cancellation period) and/or if you access any portion of the course materials via our online course spaces (i.e. via our virtual learning environment), no refund will be payable;
  • you may reschedule the course up to 7 days before the start date of the course at no additional fee. Refunded fees can be transferred to another course of the same type by contacting webinar@qatestlab.net;
  • you will be eligible for a full refund of fees paid if QATESTLAB cancels the nominated course;
  • to exercise your cancellation rights as set out above, please inform us in writing, by email to webinar@qatestlab.net;
  • any refunds will be processed within 14 days of approval and validation of the refund request;
  • we will make the refund using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise.

Please also note that we treat violations of our Terms very seriously, and we have no obligation to offer refunds to users who violate these Terms or other QATESTLAB policies.

6. QATESTLAB`s rights

All rights, titles, and interest in and to Services, our existing or future applications, our APIs, databases, and the content (lectures, articles, examples of documents, guides, memos, programs, curriculum, tasks, photos, images, illustrations)  submitted or provided through our Services are and will remain the exclusive property of QATESTLAB. Our services are protected by copyright, trademark, and other laws.

Nothing gives you a right to use our name or any of our trademarks, logos, domain names, and other distinctive brand features.

7. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL INCLUDED CONTENT ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. QATESTLAB DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF THE COURSE OF DEALING OR USAGE OF TRADE. QATESTLAB FURTHER DISCLAIMS ANY AND ALL LIABILITY RELATED TO YOUR ACCESS OR USE OF THE SERVICES OR ANY RELATED CONTENT. YOU ACKNOWLEDGE AND AGREE THAT ANY ACCESS TO OR USE OF THE SERVICES OR SUCH CONTENT IS AT YOUR OWN RISK.

8. Indemnification

You agree to indemnify, defend, and hold harmless QATESTLAB from and against any third-party claims, demands, losses, damages, or expenses, including reasonable attorney fees related to (a) your use or attempted use of the Services in violation of these Terms;  (b) your violation of any law or rights of any third party; (c) the content you post or submit. Your indemnification obligation will survive the termination of these Terms and your use of the Services.

9. Governing Law

You agree that these Terms will be governed by the laws of Cyprus, without giving effect to the provisions, policies or principles thereof respecting conflict or choice of law. In the event of any dispute related to these Terms that is not subject to binding arbitration, you and QATESTLAB will submit to courts located in Cyprus as the legal forum for any such dispute.        

10. Miscellaneous 

You agree that by registering, accessing, or using our Services, you are agreeing to enter into a legally binding contract with QATESTLAB. If you do not agree to these Terms, do not register, access, or otherwise use any of our Services.

These Terms (including any agreements and policies linked from these Terms) constitute the entire agreement between you and us (which include, Training participation terms).

We may collect and process your personal data in a manner and under conditions specified by Privacy Notice.

We reserve the right to revise the Terms at our sole discretion at any time. Any revisions to the Terms will be effective immediately upon posting by us. If we make any material change, we will notify you using prominent means, such as by email notice sent to the email address specified in your account or by posting a notice through our Services.  In all cases, your continued use of the Services after publication of such changes, with or without notification, constitutes binding acceptance of the revised Terms.
